Protecting your personal data is very important to us. We process your data strictly in accordance with legal regulations (GDPR, TKG [Austrian Telecommunications Act]). This privacy policy contains comprehensive information on the most important aspects of how your data is processed in relation to our website.

 


Contacting us

If you contact us, for instance using the website contact form or by email, your data will be used to process your enquiry and stored for a period of six months in case subsequent questions should arise. We will not disclose this data without your consent.

 

 

Data storage

You are hereby duly informed that the following data is stored for the purpose of facilitating the purchasing process and subsequent contract handling: name, address, email address, telephone number, credit card details, anonymised IP data and cookies. The data provided by you is required for contract fulfilment and the implementation of pre-contractual measures. We are unable to conclude a contract with you without these data. Your data will not be disclosed to a third party with the following exceptions: the transfer of your credit card details to the processing bank or payment processor for the purpose of debiting the purchase price; the transfer of your address details to the shipping company for the purpose of delivery; and to our tax accountant for the purpose of fulfilling our obligations under tax law.


The data stored on our servers will be deleted if the purchasing process is cancelled. In the event of a conclusion of contract, all of the data from the contractual relationship will be stored until the expiry of retention period under tax law (7 years). Furthermore, data concerning your name, address, purchased goods and date of purchase will be stored until the expiry of product liability (10 years). Data processing is based on the statutory regulations of Art. 96 Para. 3 TKG (Telecommunications Act) and Art. 6 Para. 1 (a) (consent) and/or (b) (necessary for performance of contract) of the GDPR.

 

Data processing when registering to use our web services and for contract handling
Personal data will continue to be collected and processed in accordance with Art. 6 Para. 1 (b) GDPR if you have made them available to us for the purpose of contract performance or when registering for our web services (image database and web shop). The input forms show which data will be collected. You can have your customer account deleted at any time by notifying the designated office. We store and use data provided by you for the purpose of contract completion. Your data will be blocked on full completion of the contract or deletion of your customer account in consideration of retention periods required by tax and trade law and subsequently deleted when these periods expire, unless you have explicitly agreed to the continued use of your data.

 

 

Web analysis & cookies

This website uses Google Analytics, a web analysis service operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses "cookies", which are text files placed on your computer to help the website analyse how you use the site. The information generated by the cookie about your use of the website (including the truncated IP address) will be transmitted to and stored by Google on servers in the United States.

Please note that this website uses Google Analytics exclusively with the extension “anonymizeIp()” to ensure the anonymisation of IP addresses and the exclusion of direct references to individual persons. The extension means that Google will truncate IP addresses in Member States of the European Union as well as in other countries that are party to the Agreement on the European Economic Area prior to transmission. Only in exceptional cases is the full IP address sent to and truncated by Google servers in the USA. In such exceptional cases processing will take place in accordance with Art. 6 Para. 1 (f) GDPR on the basis of our justified interest in the statistical analysis of user behaviour for optimisation and marketing purposes.

Google will use this information on our behalf for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services to us with regard to website and internet usage. Google will not associate your IP address with any other data held by Google.

Online-Marketing

This website uses the online advertising programme “Google AdWords” and, in conjunction with Google AdWords, also the conversion tracking service provided by Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). We use the Google AdWords service to draw attention to our attractive offers on external websites with the help of advertising means (so-called Google AdWords). It enables us to analyse the success of advertising measures in relation to the advertising campaign data. In doing so, we are pursuing our interest in showing you advertising of interest to you, making our website more interesting for you and achieving a fair calculation of advertising costs.


The conversion tracking cookie is set when a user clicks on an AdWords advertisement set by Google. Cookies are small text files that are stored on your computer. These cookies usually expire after 30 days and are not used for personal identification purposes. If the user visits certain pages of this website and the cookie is still valid, both Google and we can recognise that the user clicked on the advertisement and was transferred to this web page. Every Google AdWords customer receives a different cookie. This means that cookies cannot be tracked via the websites of AdWords customers. The information collected by the cookie serves to compile conversion statistics for AdWords customers who have decided to use conversion tracking. Customers are informed of the total number of users who have clicked on their adverts and were transferred to another website with a conversion tracking tag. They do not, however, receive any information that would allow the identification of an individual user. You will no longer be included in conversion tracking statistics. We use Google Adwords on account of our justified interest in targeted advertising pursuant to Art. 6 Para. 1 (f) GDPR.

Use of data for direct advertising


Subscribing to the email newsletter

If you subscribe to our email newsletter we will regularly send you information concerning our offers. The only mandatory information you need to provide to receive the newsletter is your email address. The provision of additional data is voluntary and will be used to address you in person. We use the so-called double-opt-in method for newsletter subscriptions. This means that we will only send you an email newsletter if you explicitly confirm that you consent to receiving newsletters. We will send you a confirmation email asking you to click on a link to confirm your agreement to receiving newsletters.
By activating the confirmation link you confirm that you have granted your consent allowing us to use your personal data in accordance with Art. 6 Para. 1 (a) GDPR. Subscribing to our newsletter will also result in the storage of your IP address and the time and date of your registration. This enables us to trace any misuse of your email address at a later date. The data collected by us during the newsletter subscription process are used exclusively for advertising purposes in the form of the newsletter. You can unsubscribe from the newsletter at any time via the corresponding link in the newsletter or by sending an email to online@kaindl.com. When you unsubscribe, your email address will be deleted from our email distribution list unless you have explicitly agreed to the continued use of your data or we have reserved the right to use your data for purposes permitted by law and of which we inform you in this privacy policy.


Dispatch of our email newsletters to our customer base
If you have provided your email address when purchasing goods or services, we retain the right to routinely send you email offers concerning goods or services from our range that are similar to the ones you purchased. According to Art. 7 Para. 3 UWG (Austrian Unfair Competition Act) we do not need obtain your separate consent to do so. Data processing is therefore based on our justified interest in personalised direct advertising pursuant to Art. 6 Para. 1 (f) GDPR. We will not send you any email if you have objected to the use of your email address for this purpose. You are entitled to object to the use of your email address for the purpose described in the preceding at any time in the future by sending an email to the responsible office identified in the preceding. The only costs you will incur are the transmission costs in accordance with the basic tariffs. The use of your email address for advertising purposes will stop immediately on receipt of your objection.

 

Advertisements by post
Based on our justified interest in personalised direct advertising, we reserve the right to store your first name and surname, your postal address and - insofar as we have received this additional information from you in relation to our contractual relationship - your salutation, academic degree, year of birth and your professional or business title in accordance with Art. 6 Para. 1 (f) GDPR and to use them to send you interesting offers and information about our products by post.
You can object to your data being stored and used for this purpose at any time by sending an email to online@kaindl.com.

 


Your rights

As a matter of principle, you have a right to information, correction, deletion and restriction of your data as well as to data portability, withdrawal of consent and objection. If you believe that the way your data is processed is in violation of data protection law or that your data protection rights have otherwise not been observed, you can contact the supervisory authority. In Austria it is the Austrian data protection authority.
